2025 ‘The Maynes Event’ Photography Agreement

 

This agreement is between _Maynes Event Photography_ (hereafter referred to as “Photographer” or “the Photographer”) and ___________________________________ (hereafter referred to as “CLIENT”)

1. Payment. The CLIENT will sign the agreed upon contract, and upon signature receipt the Photographer will reserve the time and date agreed upon by both parties. The CLIENT shall pay the Photographer in full by or before the selected session date. No retainer is required for booking. Please make checks payable to Brad Maynes or Amanda Maynes or ask about an electronic transfer option.

 

2. Cancellation. If CLIENT requests to amend or cancel this agreement 7 or more calendar days before the session date, the contract shall be applied to a mutually agreed upon reschedule date. Session reschedule date must be within the same calendar year. If the Photographer must cancel the session for reasons beyond their control, their liability shall be limited to a full refund of all monies paid by the CLIENT.

 

3. Artistic Rights. The Photographer retains the right of discretion in selecting the photographic materials released to the client. CLIENT may reproduce these photos for personal use only, not for commercial use or individual sale. The Photographer reserves the right to use negatives and/or reproductions for display, publications, or other purposes.  

 

4. Creative License. The Photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. Some photographs may not be possible due to changes of weather and the availability and willingness of subjects. The Photographer will do their best to honor requested photographs but do not undertake to guarantee any specific picture or incorporate and specific background, location, or group arrangement.

 

5. Force Majeure. In the unlikely event of total photographic failure, technical issues, injury, or sickness beyond the Photographer’s control, their liability shall be limited to a full refund of all monies paid by the CLIENT.

 

6. Privacy. The Photographer does not retain the CLIENT’s personal information. These details will not be made available to third parties.

 

7. Scope of Work. The Photographer will take no more than 30 calendar days to deliver finished photos to the CLIENT. Photo minimums differ depending on session length and type of session. These photos will be delivered to the CLIENT via an emailed link to the digital files, and/or on a USB drive mailed to the CLIENT upon request.

8. Finished Product. The CLIENT will receive ONLY the edited photos from their session, NOT every photo taken. Photos will be selected for editing at the discretion of the Photographer, and are promised to be the best of the session (i.e. no motion blur, closed eyes, out of focus, etc). Raw images will NOT be provided to the CLIENT.

The parties have read the entirety of this Agreement, agree to all its terms, and acknowledge receipt of a complete copy of the Agreement signed by both parties. The person or persons signing as CLIENT below shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.
